1. What This Website Is
Pendleton County Property Records is an independent information website about local deeds, assessments, tax information, and parcel mapping. It describes public sources and links to those sources but does not store official government records. The site's operators are not a government office, court, County Clerk, Assessor, or Sheriff.
2. Rules for Using This Site
Use the website only in ways permitted by law and these terms. You must not use the site or information obtained from it to:
- Stalk, harass, intimidate, threaten, or harm any person
- Commit deed fraud, identity theft, or any other fraud
- Make a consumer eligibility decision governed by the Fair Credit Reporting Act
- Scrape, copy, or republish the site's content at scale
- Interfere with the site's operation or security
3. We Are Not a Consumer Reporting Agency
The operators do not qualify as a consumer reporting agency under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). Material on this site, including output from a linked search provider, is not a consumer report. Do not use it to evaluate a person's eligibility for credit, employment, housing, insurance, or another purpose regulated by that Act.
4. Not Title, Survey, or Legal Advice
Searching public property entries does not amount to a title examination, land survey, or legal opinion. Consult a title professional about title, a licensed surveyor about a boundary, and an attorney for legal advice. This website cannot replace those services.
5. Links to Outside Sites
Outside websites and vendors, including government portals and sponsored search services, set their own terms and privacy rules. We do not control their content, whether they are available, what they charge, or how they use submitted information.
6. No Warranties
The site is offered on an "as is" and "as available" basis without express or implied warranties. We make no promise that a page is complete, accurate, or current, or that an outside portal will remain available or return a particular result.
7. Limits on Our Liability
To the fullest extent allowed by law, the site operators will not be responsible for direct, indirect, incidental, consequential, or special damages connected with using the site or a linked source. This includes harm arising from a decision based on a public-record result.
8. Indemnification
If your misuse of the site or breach of these terms leads to a claim, you agree to protect and reimburse the operators for resulting losses and reasonable legal expenses, to the extent the law permits.
9. Intellectual Property
Original writing, visual design, logo, and page arrangement are protected intellectual property. You may link to a page or quote a short passage with attribution; copying full pages or collecting site content systematically is not permitted.
10. Changes to These Terms
We can revise these terms by publishing an updated version on this page. Continued use after a revision is posted constitutes acceptance of the revised terms.
11. Governing Law
West Virginia law governs these terms, without applying its conflict-of-law rules. Public-record access requests directed to a government custodian are governed by the West Virginia Freedom of Information Act, W. Va. Code §§29B-1-1 through 29B-1-7. Under §29B-1-3, the custodian generally must respond as soon as practicable and within five days excluding Saturdays, Sundays, and legal holidays; a public body may recover actual reproduction costs but may not charge for search or retrieval time as part of that cost. That statute applies to public bodies, not this privately operated site.
12. Severability
If a court finds one provision invalid or unenforceable, the remaining provisions continue to apply.
13. Questions
For questions about these terms, use the site's Contact page.
